What Is Theft Under Kentucky Law?

Under Kentucky law, theft occurs when a person knowingly obtains property that belongs to another person by deceiving that person, by stealing the property, or by using fraud or coercion. A person who commits theft may be charged with a misdemeanor or a felony, depending on the circumstances of the crime and the value of the stolen property.

Theft crimes can be charged as either specific theft or generalized theft. Specific theft occurs when a person steals a specific item that belongs to another person. Generalized theft involves the theft of multiple items of the same type, such as the theft of multiple items of clothing or the theft of multiple electronics.


Specific theft is charged as a Class A misdemeanor, punishable by:

  • Up to 12 months in jail
  • Up to $1,000 in fines
  • Probation

Generalized theft is charged as a Class D felony, punishable by:

  • Up to 5 years in prison
  • Up to $10,000 in fines
  • Probation

How Does the Prosecutor Prove Theft in Court?
